These Terms of Service (“Terms”) govern your access to and use of the website at sellmotion.net and any related services, including our online application and onboarding forms (collectively, the “Site”), operated by McLean Marketing LLC, doing business as Motion Marketing (“Motion Marketing,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Our Services

Motion Marketing provides door-to-door field sales and marketing services on behalf of internet, television, and telecommunications brands. Through the Site, individuals may express interest in sales positions and companies may inquire about our field-marketing services. The Site is informational, and using it does not create an employment, agency, or partnership relationship. Any such relationship is formed only through a separate written agreement.

2. Eligibility

You must be at least 18 years old to use the Site or contact us through it. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.

3. Communications and SMS / Text Messaging

When you contact us through the Site, by text message, or through our application and onboarding forms, you agree that we may respond to and communicate with you using the contact details you provide.

The following terms apply to the Motion Marketing text messaging program:

Program description: Motion Marketing sends text (SMS/MMS) messages about your inquiry or engagement with us, including replies to your questions, onboarding documents (such as offer letters, independent contractor agreements, and equipment agreements), scheduling, reminders, and account or operations updates. Some messages are sent using an automated system.
How you opt in: You opt in by selecting the SMS consent option on one of our application or onboarding forms after entering your mobile number, or by texting us first at (801) 800-0549. Consent to receive text messages is not a condition of any purchase, contracting, or employment.
Message frequency: Message frequency varies based on your interactions with us.
Cost: Message and data rates may apply.
Opt out: Reply STOP to any message to cancel. You will receive one confirmation message and no further texts unless you opt in again.
Help: Reply HELP for help, or contact us at admin@sellmotion.net or (801) 800-0549.
Carriers: Carriers are not liable for delayed or undelivered messages.
Privacy: We do not share, sell, or provide your mobile phone number or text messaging consent data to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

4. Acceptable Use

You agree not to use the Site to:

Violate any law or regulation, or infringe the rights of others;
Submit false, misleading, or fraudulent information;
Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
Transmit any malware, spam, or harmful code; or
Use automated means to scrape or harvest data from the Site without our written permission.

5. Intellectual Property

The Site and its content, including the Motion Marketing name, logo, text, graphics, and design, are owned by McLean Marketing LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written consent.

6. Third-Party Services

The Site relies on third-party services, including our form and messaging providers. We are not responsible for the availability, content, or practices of third-party services, and your use of them may be subject to their own terms and policies.

7. No Earnings or Employment Guarantee

Any references on the Site to commissions, income, advancement, or results describe potential outcomes only and are not promises or guarantees. Sales roles are performance-based, and actual earnings depend on individual effort, skill, market conditions, and other factors. Expressing interest through the Site does not guarantee an offer of a position, engagement, or any particular outcome.

8. Disclaimer of Warranties

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Motion Marketing and McLean Marketing LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Motion Marketing, McLean Marketing LLC, and their officers, members, and employees from any claims, damages, or expenses arising out of your use of the Site or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
